A letter of demand to MolPay to show proof that they did not disclose details of my customers to the police

A LETTER of demand was served to MolPay Sdn. Bhd. on 23 December 2014 demanding explanation whether or not they had given details of my customers to the police. The letter was sent by lawyer Syahredzan Johan from firm RamRais.

On 17 November 2014, MolPay (as a payment gateway for my official website, www.zunar.my) had informed me through email that police had contacted them and requested the details of the customers who had purchased books through the said website.

The company also informed that they had no choice but to furnish the details to the police. In my reply requesting for clarification in regards to the contents of the email, MolPay subsequently informed that the request by PDRM was made in written form. Several days later, MolPay made a statement that the decision to furnish customers’ details to the police was made by one of their departments and the decision was purportedly ‘revoked’ by the management of the company several days later. The also denied giving the information to the police.

I wrote another email to the company to provide me a concrete proof to support the denial, such of documents or letters, but they refused. Since this issue arises, my online business has severely affected as the customers and potential customers are scared to order my books online. Without a concrete proof from MolPay, I am unable to convince my costumers about their privacy data security when ordering my books online.

Since Molpay refused to cooperate, in the legal letter to them, I demand:

  1. A copy of the written request by PDRM requesting the online payment receipts;
  2. A copy of written reply to PDRM regarding the written requests.

They are given 14 days to reply.

I would also like to remind MolPay that disclosing the details to any parties without my permission is a violation of the Personal Data Protection Act 2010, guranteed by the company to their client. I will wait for a response from MolPay before deciding the next step of action.

RELATED BACKGROUND

On 6 November 2014, three of Zunar’s assistants were arrested and taken to the police station for selling latest cartoon books. Few days after that, the webmaster, who has been managing Zunar’s website and online bookstore, has been called by the police for investigation under the Sedition Act.

On 20 November, Zunar was investigated at Dang Wangi Police Station in Kuala Lumpur under the “Classified Crime Section” involving three different laws — Printing Presses and Publications Act, the Sedition Act and Penal Code, after two separate police reports were made against him.


Surat tuntutan kepada MolPay untuk memberi bukti bahawa mereka tidak mendedahkan butiran leengkap pelanggan-pelanggan online saya kepada polis

SATU surat tuntutan dihantar kepada MolPay Sdn. Bhd. pada 23 Disember 2014 meminta penjelasan sama ada mereka telah memberi atau tidak memberi butiran lengkap pelanggan-pelanggan online saya kepada polis. Surat tersebut dihantar oleh peguam saya, Syahredzan Johan dari firma guaman RamRais.

Pada 17 November 2014, MolPay (yang bertindak sebagai pengurus sistem jualan bagai laman rasmi saya, www.zunar.my) memaklumkan melalui email bahawa mereka menerima permintaan dari pihak polis untuk mendedahkan butiran lengkap pelanggan-pelanggan yang membeli buku secara atas talian di laman tersebut.

Molpay juga memberitahu bahawa mereka tidak mempunyai pilihan selain dari memenuhi permintaan pihak polis.

Apabila saya meminta penjelasan mengenai kandungan email tersebut, pihak MolPay mengaku permohonan pihak polis itu dibuat secara bertulis.

Beberapa hari selepas itu, MolPay membuat kenyataan bahawa keputusan untuk memenuhi permintaan polis itu adalah keputusan awal yang dibuat oleh sebuah jabatan dalam syarikat itu dan keputusan itu dikatakan telah dibatalkan oleh pihak pengurusan syarikat beberapa hari selepas itu. Mereka juga menafikan membuat pendedahan maklumat pelanggan saya kepada pihak polis.

Saya menulis satu lagi email kepada MolPay meminta bukti-bukti konkrit bagi menyokong penafian tersebut seperti dokumen atau surat, tetapi mereka enggan. Sejak isu ini berbangkit, perniagaan saya terjejas teruk kerana pelanggan-pelanggan dan bakal pelanggan takut untuk memesan buku secara online. Tanpa bukti konkrit dari MolPay, saya tidak akan dapat meyakinkan pelangan-pelangan saya akan keselamatan data perinadi mereka apabila memesan buku saya secara online.

Kerana MolPay enggan memberi kerjasama, melalui surat kepada syarikat tersebut, saya menuntut:

  1. Salinan surat permohonan dari pihak polis untuk mendapatkan butiran lengkap pelanggan-pelangan saya
  2. Salinan surat jawapan kepada pihak polis berkenaan permohonan bertulis dari mereka.

Saya juga ingin mengingatkan pihak MolPay bahawa sebarang pendedahan maklumat pelanggan-pelanggan saya yang dibuat kepada mana-mana pihak tanpa kebenaran saya adalah menyalahi Akta Perlindungan Data Peribadi 2010 yang dijamin oleh syarikat tersebut.

Pihak MolPay diberi masa selama 14 hari untuk membalas surat tersebut. Saya akan menunggu jawapan dari MolPay sebelum meutuskan tindakan berikutnya,

LATAR BELAKANG BERKAITAN

Pada 6 November 2014, tiga pembantu Zunar telah ditangkap dan disiasat di Balai Polis Putrajaya kerana menjual buku kartun bertajuk “Konspirasi Memenjarakan Anwar” dan “Pirate of the Carry-BN “.

Dalam tangkapan itu, sebanyak 44 buah buku turut dirampas oleh polis. Pada 12 November 2014, pengendali laman web telah rasmi Zunar (zunar.my) pula dipanggil polis untuk disoal siasat.

Selain itu, Zunar sendiri pada 20 November lepas telah disoal siasat di balai polis Dang Wangi di bawah Akta Mesin Cetak dan Akta Penerbitan, Akta Hasutan dan Kanun Keseksaan kerana menerbitkan buku-buku kartun tersebut.
